Read carefully these general terms and conditions of contract (the “Terms and Conditions of Contract”) before hiring any product/service through the website https://zamnacommunity.com (the “Website”), since the contracting of products/services through this Website will be governed by these Terms and Conditions of Contract. If you do not agree with these Terms and Conditions of Contract, do not contract products/services through it.
This Website is managed by ZAMNA WORLD LLC (hereinafter, “Zamna World”), a company organized under the laws of Florida, with FEI/EIN Number 61-2004278, and with principal address at 106 SE 9TH STREET, FORT LAUDERDALE, FL 33316, USA.
All communications and notifications that the Client directs to Zamna World must be sent by email to info@zamnacommunity.com or through the chat enabled on the Website.
The observance and compliance with these Terms of Use will be required of any User accessing and browsing the Website, so if you do not agree with the terms set forth, do not browse or use the Website.
In addition to other terms that are defined throughout these Terms and Conditions of Contract, the following terms shall have the meaning indicated below:
“Customer” refers to the User who acquires any Entry through the Website or any other purchase process enabled by Zamna World. For explanatory purposes, in the event that the Entry is nominative, only the “Purchaser” will be considered as the “Client” to whom the purchase is made, not the rest of the Ticket holders.
“Entry(s)” refers to the document that entitles you to enter the selected Event through the Purchase Process or through any other purchase process enabled by Zamna World.
“Event” refers to any leisure or entertainment activity organized by one or several Promoters, for whose attendance an Entry can be acquired through the Website via the Purchase Process enabled by Zamna World or another purchase process enabled for that purpose by Zamna World.
“Event Information” refers to the information that appears on the Website related to an Event. For explanatory purposes, this information is provided to Zamna World by the Promoter that in each case corresponds, and is updated by the same and is their sole responsibility. In some cases, a link may be provided that redirects to the Promoter’s website.
“Purchase Process” refers to the procedure explained in clause 5.
“Promoter(s)” refers to third parties, other than Zamna World, who supply goods and/or services that, by decision of Zamna World, offer their goods and/or services for sale through the Website.
“Sales Service” refers to the service described in clause 2.1.
“Terms and Conditions of the Promoter(s)” refers to the terms and conditions of sale according to the Purchase Process and/or the commercial terms of any Promoter (including, but not limited to, the Promoter’s data protection policy, reservation policy, delivery policy, admissions policy, and refund and reimbursement policy of said Promoter, as applicable).
“User(s)” refers to natural or legal persons considered final consumers.
The “Sales Service” or Management, service, and distribution expenses encompass all services provided by the platform to Users for ticket location, customer support, and transaction facilitation.
2.2. The number of Tickets made available to Zamna World for sale varies from one Event to another depending on the Tickets assigned to Zamna World by the Promoter. All distribution points access the same inventory and ticketing system, and therefore, Tickets to popular Events can be depleted quickly. Occasionally, more Tickets may be made available before the Event, but Zamna World has no control over that inventory or its availability. In any case, it will be indicated through the Website when the Tickets to an Event are sold out. 2.3. The Promoters’ Terms and Conditions of Contract may prevent Zamna World from issuing Entries to replace lost, stolen, damaged, or destroyed Tickets. If substitute Tickets are issued, the Client, according to the conditions of each Promoter, may be required to pay corresponding administration expenses, of which prior notice will be given. Zamna World assumes no responsibility for any lost, stolen, damaged, or destroyed Ticket. 2.4. Any Ticket that is wrinkled, torn, or shows signs of falsification may authorize the Promoter to deny the bearer access to the Event if its authenticity cannot be proven. Therefore, it is the Client’s responsibility to keep the Ticket in good condition, as well as to take the necessary actions, if applicable, to prove its authenticity.The User may purchase Tickets for each Event through the Website https://zamnacommunity.com. Notwithstanding that at all times you will be guided in the purchase process, below, in a generic way, are the steps of the Purchase Process (the “Purchase Process”):
If you already have a user account, log in.
The creation of an account is mandatory to purchase Tickets; therefore, you cannot acquire them without registering.
In the Legal Notice and Conditions of Use, you have additional information about the user access area.
For informational purposes, it is stated that Zamna World acts on behalf of the Promoter regarding the purchase of Tickets through the Website, meaning it processes the Clients’ data for this purpose (the purchase of the Ticket) as an intermediary for the Promoter, not as the primary data controller. For more information in this regard, you may consult Zamna World’s Data Protection Policy.
In the event that the Tickets are nominative, the User who is completing the purchase must provide the data required regarding the holder of each Ticket. The User guarantees that they have informed the corresponding person about the use of the data provided and that they have obtained their consent for the communication and processing of such data by Zamna World and by the Promoter of the relevant Event, according to the terms set forth in Zamna World’s Data Protection Policy.
If you select bank transfer as the payment method, after confirming the order for Tickets, Zamna World will send the Customer an “order confirmation” email to the address provided during the registration process on the Website. This email will include, among other details: the data of your purchase, the order number, the bank account number where the transfer must be made, and the reference or concept that the Customer must include in the bank transfer.
You will have seven (7) days to make payment of the amount indicated in the “order confirmation” email. Once this period has elapsed, the order cannot be completed and the Tickets will again be made available for purchase through the Website. Notwithstanding the seven (7) day period stated, this term may be shorter if the Event date is less than said term away.
The order will be processed once payment has been received by Zamna World.
It is possible that the Customer may need to visit their bank in person to complete the transfer. This does not depend on Zamna World, but on the terms of the Customer’s bank.
In addition, the Website may enable a chat through which you can contact Zamna World in order to, among other purposes, purchase Tickets. The payment method, in this case, will be via bank transfer, following the instructions provided by Zamna World.
The chat must be used in compliance with the provisions of the Legal Notice and Conditions of Use.
Once you select the payment method, if you wish to complete the Purchase Process, you must click on the box enabled for the purchase confirmation. At that time, the Customer confirms that the payment information entered is correct and truthful and accepts that Zamna World will charge the price of the Ticket(s).
The User undertakes—and is solely responsible—to review prior to payment the Promoter’s Terms and Conditions, the Event Information, the Promoter’s data protection policy, and these Contracting Terms and Conditions, thus exempting Zamna World from any liability in this regard.
Zamna World is working to have an event insurance policy that offers favorable terms for the Client. As soon as it becomes available, the Client will have the option to purchase it during the Purchase Process, having been previously informed of the applicable terms.
9.1. Zamna World may limit the number of Tickets that a Customer can purchase for each Event.
9.2. The illegal resale of a Ticket or any attempted illegal resale constitutes sufficient cause for the seizure or cancellation of said Ticket, without the right to reimbursement or any other type of compensation.
9.3. A Ticket may not be used for advertising, promotions, contests, or sweepstakes unless the written authorization of the Promoter is obtained. However, in the event that such consent is obtained, the Customer will be responsible for obtaining the corresponding authorization for the use of trademarks and other intellectual and industrial property of Zamna World, the Promoter, and/or any third party whose intellectual and industrial property appears or is mentioned in the Ticket. Likewise, the Customer will be responsible for the processing of any personal data they carry out when using Tickets in advertising, promotions, contests, or sweepstakes.
10.1. No changes or refunds of the Tickets will be accepted, except as expressly provided in the Promoter’s Terms and Conditions. The Client may not exercise any right of withdrawal or resolution, in accordance with current Florida regulations regarding consumers and users for this type of product.
At Zamna World, we offer a comfortable, easy, and safe way to buy tickets, acting as distributors and intermediaries between our Clients and the Promoters we work with. No refunds are allowed, but if you made a mistake in your purchase, or wish to upgrade or change, you must contact us at least 72 hours before the event; otherwise, we will not be able to assist you.
10.2. The inability to attend an Event or any error made when purchasing Ticket(s) (for example, entering an incorrect email address or any other data during the purchase process) are not grounds for returning the Ticket(s). However, you can always contact Zamna World through the channels indicated in these Terms and Conditions of Contract.
10.3. Neither adverse weather conditions nor other causes of force majeure (pandemic, storm, hurricane, etc.) entitle the Client to a refund of the Ticket price.
10.4. In the event of any cancellation or change to an Event, Zamna World undertakes to (i) publish such information on the Website as soon as the Promoter informs us and (ii) send an email to the Client at the address provided during the registration process, informing them about such cancellation or change.
10.5. Cancellations or changes that occur after receipt of the Purchase Confirmation—such as changes of date, venue, or artists—are at the sole discretion of the Promoter. As an intermediary, Zamna World may only proceed with cancellation of the Tickets (and thus refund the Price) once we receive an express order to do so from the Promoter. In no event will Zamna World be held responsible for any cancellations or changes that are the Promoter’s responsibility, including any direct (for example, the Ticket price) or indirect (for example, travel, accommodation, etc.) damages.
10.6. If a refund is authorized, Zamna World will reimburse the Client using the same payment method used for the original purchase.
Management, service, and distribution expenses comprise the overall service provided to Users by the platform to locate Tickets, provide support, and enable transactions. In cases of changes or refunds, these fees are non-refundable as they are independent transactions.
10.7. Zamna World is a mere intermediary in the sale of Event Tickets, does not participate in the organization of said Events, and therefore has no control over their cancellation or modification. Such responsibility rests directly with the Promoter. Any claim concerning the cancellation of an Event must be addressed to the Promoter by presenting the Ticket and any additional information or documentation that the Promoter may require at any time.
The perfection, completion, or conclusion of the purchase of Tickets via the https://zamnacommunity.com platform is subject to verification of the personal information and credit/debit card details provided by the Client, as well as the issuing bank’s authorization of the relevant charge. If the personal information or card details provided by the Client do not match the information available to the issuing bank, or if the issuing bank or acquiring/accepting bank does not authorize the transaction, the purchase will not be processed or finalized, and the Tickets will be made available for sale to the public with no liability for https://zamnacommunity.com or Zamna World.
Notwithstanding the above, the Client expressly acknowledges and agrees that the Ticket purchase request made through the https://zamnacommunity.com / Zamna World system is a binding offer and that, upon receiving authorization from the relevant credit/debit card issuing bank or accepting bank, the purchase transaction shall be final and not subject to changes, refunds, returns, or cancellations.
Therefore, the Client expressly acknowledges and accepts that they are not entitled to changes, refunds, returns, or cancellations—even if they fail to print or make use of the purchased Tickets. The Client expressly recognizes and agrees that they are only entitled to a refund of the Ticket cost if the event for which the Ticket was purchased is canceled. In such a case, the Client is NOT entitled to a refund of Zamna World’s management fees.
Any postponement of the event is solely the Promoter’s responsibility. If necessary by order of the competent authority, such postponement shall not impose any liability on Zamna World or https://zamnacommunity.com, and any refund of the purchase amount will be made in the form of a WALLET (electronic purse).
IMPORTANT: Each event requires a physical or digital Ticket. Each Ticket has a unique QR code and reference number. https://zamnacommunity.com assumes no responsibilit
11.1. The Customer may access the Event by delivering the printed Entry in the access to the Event venue where they will validate the Entry. Even if several copies of the Entry are printed, only the first Entry presented in the access will be considered valid. Therefore, access to the site will not be allowed, in any case, to those who subsequently try to access with the same Entrance. In the event that the Entry is nominative, the Client must be accompanied by the necessary documentation that sufficiently proves his identity for the Entry to be validated. Otherwise, you may be denied access to the venue where the Event is held.
11.2. Access to the venue where the Event is held is subject to the access and exit policies established by the Promoter.
Without prejudice to other cases of exemption from liability established in these Terms and Conditions of Contract:
12.1. Zamna World shall not, under any circumstances, be liable if the Client is denied access to the venue, regardless of the reason for such refusal. The Promoter always reserves the right of admission.
12.2. Zamna World does not participate in organizing the Events and, therefore, is not responsible for how they are ultimately carried out. Any claims related to the organization or quality of the Event must be directed solely to the Promoter.
12.3. Zamna World shall be released from any liability that may arise from the unauthorized inclusion—by the Promoter—of any distinctive signs or domain names owned by Zamna World, or any reproductions or references that include Zamna World’s name, on any type of medium displayed in unauthorized public spaces.
13.1. We may periodically review these Terms and Conditions of Contract, particularly under the following circumstances:
13.2. Each time the Client accesses the Website to use the Sales Service, the version of the Terms and Conditions of Contract valid at that moment will apply to the contract between the Client and Zamna World.
13.3. In the event of a revision of these Terms and Conditions of Contract based on this clause, Zamna World will inform and notify such modification, clearly indicating that these Terms and Conditions of Contract have been modified and specifying the date on which they will take effect.
14.1. If any competent authority determines that any of these Terms and Conditions of Contract is void, unlawful, or unenforceable to any extent, this determination will not affect the remaining terms, conditions, and provisions, which will remain valid to the fullest extent permitted by law.
14.2. These Terms and Conditions of Contract shall be governed by and interpreted in accordance with the laws of the State of Florida. In the event that the applicable regulations provide for the possibility of choosing a jurisdiction, Zamna World and the Client, expressly waiving any other jurisdiction that may apply to them for the interpretation and resolution of conflicts that may arise between them as a consequence of these Terms and Conditions of Contract, submit to the jurisdiction of the courts and tribunals of the State of Florida.
